Welcome to the “Sequence Analysis of Mycobacterium tuberculosis (SAM-TB)” platform！

This agreement stipulates the rights and obligations between this platform (hereinafter referred to as “SAM-TB platform”) and the users regarding the genetic data analysis services (hereinafter referred to as “services”). The“Users” refer to individuals who register, log in, and use the SAM-TB platform. Please read this “User Agreement” (hereinafter referred to as the "Agreement") carefully to ensure that you fully understand the terms of this agreement. If you do not agree with any content of this agreement, or you cannot accurately understand the company’s interpretation of the terms, please cancel your account. If you register as a user of the platform, it means that you have fully read, recognized and agreed to abide by the entire content of this agreement.

###Registration

1. You need to register an account before using the service. The account should be bound to an e-mail address. The SAM-TB platform can change the account registration and binding methods according to user or product needs without notifying the user in advance.

2. When you register and use the services, you need to provide some personal information that allows you to be distinguished from other users, can be contacted when necessary, or provided with a better experience. The information includes but is not limited to your real name, telephone number, unit and position. The SAM-TB platform agrees to protect the privacy of your information.

3. You are responsible for the safety of the registered account information and password. If your account or password is stolen because you fail to keep it secure, you shall bear the responsibility. You shall bear legal responsibility for all behavior under the registered account and password. You should immediately notify the SAM-TB platform when the you suspect that your account are used by someone else.

###The service contents

1. The SAM-TB platform provides professional genetic data analysis and interpretation services, including but not limited to sample information management, genetic sequencing data analysis, and sharing of data and analysis results.

2. The SAM-TB platform may change the services provided. You will receive a notice when the SAM-TB platform makes changes to the services.

3. The services provided by the SAM-TB platform are free. You can store and analyze whole genome sequencing data of up to 100 samples. If you need to analyze more samples, please contact us.

###Rules of use

1. You shall abide each terms of this agreement and use the service correctly and appropriately. If you violate any term in this agreement, the SAM-TB platform will have the right to suspend or terminate the services after notifying you. At the same time, the SAM-TB platform reserves the right to withdraw an account at any time.

2. You are responsible for the authenticity, legality, harmlessness, accuracy, and validity of the registration information and other data in the SAM-TB platform. You bear the legal responsibilities related to the usage of the services and the content of the data you provide, which shall have nothing to do with the SAM-TB platform. If any damage is caused to the SAM-TB platform or a third party, you shall compensate according to law.

3. You are not allowed to use SAM-TB platform accounts or services to perform the following actions:

- Provide the account to any third-party company, institution or individual for use in any way;

- Use other users' accounts or passwords;

- Use the SAM-TB platform or services to engage in any illegal and criminal activities;

- Other violations of laws and regulations, infringement of the legitimate rights and interests of other users, or interference with the normal operation of the SAM-TB platform.

- Reverse engineer or compile the SAM-TB platform, or try to discover the source code of the platform and related analysis software in other ways;

- Actions such as copy, modify, link, reprint, compile, publish, and establish mirror sites of the intellectual property content of the SAM-TB platform;

- Log in or use the SAM-TB platform and services through third-party software, plug-ins and systems that are not developed and authorized by the platform.

4. If you are banned due to violating the agreement, you can contact us to check the duration of the banned period, and apply for unblocking after the ban expires. If you have been banned for particular functions, the banned functions will be automatically restored after the period expires. The blocked user can submit an appeal to the SAM-TB platform. The platform will review the appeal and make a reasonable judgment to decide whether to change the punishment measures.

###Information protection

1. The SAM-TB platform respects the privacy of your information. The SAM-TB platform will take technical and other necessary measures to ensure the safety of your information and prevent the leakage, damage or loss of the information. The SAM-TB platform will promptly take remedial measures and notify you should any leakage, damage or loss of the information occur or the SAM-TB platform finds that these situations may occur. If you find the that any of these situations have occurred you should also contact the SAM-TB platform immediately.

2. The information includes: 1) Your personal information, such as your name, e-mail address and telephone number provided during registration; 2) Data information you have uploaded, such as clinical data and sequencing data of samples. The clinical data refers to metadata information related to the sample, such as patient name, clinical diagnosis, and clinical phenotype. Non-private information refers to the basic record, other information outside the scope of personal and data privacy information, and the privacy information that you agree to disclose. The SAM-TB platform guarantees that it will collect, use or disclose your private information only after obtaining your written consent. The SAM-TB platform can collect, use or disclose the non-private information without obtaining your confirmation and authorization.

3. The SAM-TB platform will not use your uploaded data and will not disclose your private information to any third party without your consent, except in the following situations:

- The SAM-TB platform will provide your personal privacy information in accordance with the laws and regulations or instructions from relevant authorities;
 - Any information leakage caused by yourself.
 - The disclosing of the private information to third parties by yourself.
 - There is an agreement between you, the SAM-TB platform and the cooperation units on the use of the privacy information. In this case, the SAM-TB platform will disclose the privacy information to the cooperation units.
 - Any leakage of the privacy information due to hacker attacks, computer virus intrusion and other force majeure events.

###Risk warning

1. You should fully understand and agree that the results of data analysis are unpredictable, and that you cannot claim any liability of the SAM-TB platform for analysis results that do not meet your expectations.

2. You should understand and agree that the SAM-TB platform only provides genetic data analysis service, and you must be responsible for all actions under your registered accounts, including all the contents generated by your analysis and any consequences arising therefrom. You should make your own judgments on the contents produced by the SAM-TB platform and services, and bear all risks arising from the use of the contents, including the risks arising from the reliance on the correctness, completeness or practicality of the contents. The SAM-TB platform cannot and will not be liable for any loss or damage caused by your actions.

3. You should understand and agree that the SAM-TB platform reserves the right to unilaterally change, suspend, terminate or cancel all or part of the services due to business development needs. You shall bear this risk.

###Intellectual property

1. Unless otherwise stated, the copyright, patent rights and other intellectual property of the analysis pipelines belong to the SAM-TB platform.

2. The copyright or trademark rights of the graphics, text or their composition involved in the services, as well as other SAM-TB platform logos, products and service names (hereinafter collectively referred to as the "SAM-TB platform logo"), belong to the SAM-TB platform. Without the written consent of the SAM-TB platform, you shall not display or use the SAM-TB platform logo in any way or perform other processing, and shall not indicate to others that you have the right to display, use, or process the SAM-TB platform logo.

3. The above and any other intellectual property rights owned by the SAM-TB platform are protected by law. Without the written permission of the SAM-TB platform, you are not allowed to use or create related derivative works in any form.

###Disclaimer

1. You should understand and confirm that this platform does not provide the service of data storage. You need to back up your data and save the analysis results in a timely manner. The SAM-TB platform does not bear any responsibility for losing your uploaded data.

2. You should understand and confirm that there are risks of service interruption or failure to meet your requirements due to force majeure, computer viruses or hacker attacks, system instability, communication line failures, etc. The SAM-TB platform does not assume any responsibility for the losses caused by such situations.

3. You should understand and confirm that the SAM-TB platform and the related equipment needs to be overhauled or maintained on a regular or irregular basis. If such a situation causes service interruption within a reasonable time, the SAM-TB platform does not need to bear any responsibility. However, the SAM-TB platform should notify you in advance of any interruption in services.

###Account cancellation

You can cancel your account by communicating with the customer service of the SAM-TB platform. Before the account is cancelled, you shall back up any of the data and information related to the account that you wish to save.

###Other matters

1. Please pay attention to the terms in this agreement that exempt the SAM-TB platform from liability and restrict your rights. You are requested to read this agreedment carefully and consider the risks independently.

2. The validity, interpretation and dispute resolution of this agreement are governed by the laws of China. If any dispute occurs between you and the SAM-TB platform, friendly negotiation will first be used to try to settle the dispute. If the negotiation fails, you must agree to submit the dispute to the people's court in the jurisdiction where the SAM-TB platform located.

3. If any of the terms of this agreement are invalid or unenforceable for any reason, the remaining terms are still valid and binding on both parties.

4. This agreement can be updated at any time by the SAM-TB platform. Once the updated agreement terms are announced, they will replace the original ones without prior notice. You can check the latest version of the terms on the website. If you do not accept the modified terms, please stop using the services immediately. If you continue to use the services provided by the SAM-TB platform, you will be deemed to have accepted the modified agreement.
